Ministerial Resolution

HAVING SEEN, File No. 2025-0055363, which includes Report No. 000003-2025/DIGDOT-MINSA from the General Directorate of Donations, Transplants and Blood Bank; Memorandum No. D002520-2025-DVMSP-NZT-MINSA from the Office of the Vice Minister of Public Health; and Report No. D000237-2025-OGAJ-MINSA from the General Office of Legal Advisory;
WHEREAS:
That, Subparagraph VI of the Preliminary Title of Law No. 26842, the General Health Law, establishes that the provision of health services is of public interest, regardless of the person or institution providing them, and that it is the responsibility of the State to promote conditions that ensure adequate coverage of health services for the population, in terms that are socially acceptable with respect to safety, timeliness, and quality;
That, Article 123 of the aforementioned Law, as amended by Article 2 of Law No. 30895, Law that Strengthens the Governing Role of the Ministry of Health, establishes that the Ministry of Health is the national Health Authority, responsible for the governing function at the national level, as well as for the formulation, direction, and management of national health policy, and is the highest governing authority in the sector. Its purpose is the promotion of health, the prevention of disease, the recovery of health, and the rehabilitation of the population’s health;
That, Article 4 of Legislative Decree No. 1161, Law on the Organization and Functions of the Ministry of Health, provides that the Health Sector is composed of the Ministry of Health, as the governing body, the entities attached to it, and those public and private institutions at the national, regional, and local levels, as well as natural persons who carry out activities related to the competencies established in said Law, and that have a direct or indirect impact on individual or collective health;
That, Article 6 of the Regulations of Law No. 30895, Law that Strengthens the Governing Role of the Ministry of Health, approved by Supreme Decree No. 030-2020-SA, establishes that it is an inescapable function of the State, exercised exclusively through MINSA, to assume responsibility for the promotion, protection, and respect of the health, life, and well-being of the population, as well as to lead the Health Sector. Stewardship in health implies protecting health as a human right and a public good;
That, Law No. 26454, which declares the procurement, donation, preservation, processing, transfusion, and supply of human blood to be of public order and national interest, in its Article 1 establishes that the procurement, donation, preservation, processing, transfusion, and supply of human blood, its components and derivatives, are of public order and national interest; and in its Article 9, it provides that the donation of human blood is a voluntary and unpaid act carried out for therapeutic or scientific research purposes;
That, in accordance with the aforementioned Law No. 26454, Article 22 of its Regulations, approved by Supreme Decree No. 03-95-SA, establishes that the donation of blood or its components is a voluntary, supportive, and altruistic act, whereby a person freely and consciously donates, without compensation, a portion of their blood for therapeutic, diagnostic, or research purposes; and, in its Article 33, it specifies that PRONAHEBAS coordinates intersectoral, ongoing public awareness campaigns aimed at the population, using mass media in order to raise interest in human blood donation and, at the same time, to encourage it through various forms of recognition;
That, in accordance with the legal framework described above, and within the scope of its competencies, the General Directorate of Donations, Transplants and Blood Bank, through Report No. 000003-2025/DIGDOT-MINSA, proposes granting public recognition to the WeLoveU International Foundation, in consideration of its solidarity work over approximately twenty (20) consecutive years, during which it has carried out various blood donation campaigns in Peru, achieving the participation of more than 7,500 voluntary donors, all of which benefits the health and lives of the Peruvian population, and also demonstrates its dedicated efforts in promoting voluntary and unpaid blood donation in the country;
Que, en virtud de ello, el Ministerio de Salud estima necesario reconocer públicamente la loable labor que viene realizando la Fundación Internacional WeLoveU en beneficio de la salud y la vida de la población peruana;
That, by virtue of the foregoing, the Ministry of Health deems it necessary to publicly recognize the commendable work carried out by the WeLoveU International Foundation for the benefit of the health and lives of the Peruvian population;
Based on the proposal of the General Directorate of Donations, Transplants and Blood Bank;
With the endorsement of the General Directorate of Donations, Transplants and Blood Bank, the General Office of Legal Advisory, the General Secretariat, and the Office of the Vice Minister of Public Health;
In accordance with Legislative Decree No. 1161, Law on the Organization and Functions of the Ministry of Health, as amended by Law No. 30895, Law that Strengthens the Governing Role of the Ministry of Health, and by Legislative Decree No. 1504, which strengthens the National Institute of Health for the prevention and control of diseases; as well as the Regulation on the Organization and Functions of the Ministry of Health, approved by Supreme Decree No. 008-2017-SA, as amended by Supreme Decrees No. 011-2017-SA and No. 032-2017-SA;
IT IS RESOLVED:
Article 1.- To grant public recognition from the Ministry of Health to the WeLoveU International Foundation, in acknowledgment of its valuable contribution to the promotion of voluntary and unpaid blood donation in Peru, through blood donation campaigns carried out for the benefit of the health and lives of the Peruvian population.
Article 2.- To notify the WeLoveU International Foundation of this Ministerial Resolution.
Article 3. - To entrust the Office of Transparency and Anti-Corruption of the General Secretariat with the publication of this Ministerial Resolution on the Institutional Portal of the Ministry of Health (www.gob.pe/minsa).
